الحد الفاصل بين الفضاء الجوي و الفضاء الخارجي- دراسة فقهية قانونية -
Résumé: ملخص: تسلط هذه الدراسة الضوء على مسألة قانونية لا تزال مطروحة إلى الآن للمناقشة في لجنة استخدام الفضاء الخارجي في الأغراض السلمية التابعة لهيئة الأمم المتحدة، هي مسألة تعين الحد الفاصل بين الفضاء الجوي و الفضاء الخارجي. و تهدف الدراسة إلى لفت الانتباه لوجود ثغرة قانونية في كل من قانون الفضاء و قانون الجو الدوليين راجعة لعدم تحديد الارتفاع الذي تنتهي عنده سيادة الدولة على مجالها الجوي لتبدأ منه حرية الفضاء الخارجي، و تخلص إلى نتيجة هي إمكانية تعريف الفضاء الخارجي و تعين الحد الفاصل بينه و بين الفضاء الجوي بالاعتماد على الدراسات الفقهية و على الممارسة الدولية. Abstract: This study sheds light on a legal issue that is still being discussed in the Committee on the Peaceful Uses of Outer Space for Peaceful Purposes of the United Nations, a matter that defines the boundary between airspace and outer space. The study aims to draw attention to the existence of a legal loophole in both space law and international air law due to the failure to determine the height at which the state’s sovereignty over its airspace ends, from which the freedom of outer space begins. The boundary between it and the airspace was determined based on jurisprudence studies and international practice.
