خصوصية التحقيق القضائي في الجرائم العسكرية

Résumé: الأصل أن يكون التحقيق القضائي مكنة انفرادية بقاضي التحقيق المختص إقليميا وفقا ما حددته المادة 40 من قانون الإجراءات الجزائية، إلا أن خصوصية بعض الأفعال المجرمة لارتباطها بمجالات سيادية وحيوية، ولخصوصية من يقترف الواقعة الجرمية كونها تمس مصالح استراتيجية مرتبطة بالأمن القومي، فإن المشرع الجزائري قد أخرج أشخاصا وأفعالا معينة تتعلق بالمصالح العسكرية من دائرة اختصاص قاضي التحقيق العادي، وأدخلها في نطاق اجرائي خاص أسندت مهمته لقاضي تحقيق عسكري تابع وظيفيا لهيكل القضاء العسكري، والذي تحدد اختصاصه مجموعة من الضوابط، والتي بدورها تمنحه عديد السلطات والصلاحيات في مباشرة أعماله المرتبطة بمرحلة التحقيق القضائي العسكري. The rule is that the judicial investigation should be a unilateral mechanism with the regionally competent investigative judge, according to what was specified in Article 40 of the Code of Criminal Procedure. However, the specificity of some criminal acts due to their connection to sovereign and vital areas and the privacy of the perpetrator of the criminal incident as it affects strategic interests, the Algerian legislator has directed certain persons and actions related to Military interests from the jurisdiction of the ordinary investigating judge and included it in a special procedural scope. His mission was assigned to a military investigation judge who is functionally subordinate to the structure of the military judiciary, whose competence is determined by a set of controls, which in turn grant him many powers and powers in carrying out his work related to the stage of the military judicial investigation.
