ﻗﺎﻧﻮﻥ ﺍﻟﻮﻇﻴﻔﺔ ﺍﻟﻌﻤﻮﻣﻴﺔ ﺍﻟﺴﻠﻄﺔ ﺍﻟﺮﺋﺎﺳﻴﺔ ﻓﻲ ﻗﺎﻧﻮﻥ ﺍﻟﻮﻇﻴﻔﺔ ﺍﻟﻌﻤﻮﻣﻴﺔ ﺍﻟﺠﺰﺍﺋﺮﻱ

Résumé: تهدف هذه الدراسة الى تسليط الضوء على السلطة الرئاسية في قانون الوظيفة العمومية الجزائري حيث تطرقنا في الفصل الاول الى مفهوم وتعريف السلطة الرئاسية التي تعتبر علاقة قانونية مبنية على مفهوم التبعية الإدارية وواجب الطاعة المفروض على المرؤوس اتجاه رئيسه الإداري الأعلى منه والعلاقة الوظيفية بين الموظف و الإدارة و العقوبات التاديبية التي يتعرض اليها الموظف اذا قصر في الواجبات الموكلة اليه. اما في الفصل الثاني تناولنا صلاحيات السلطة الرئاسية و سلطات الرئيس على اعمال المرؤوس حيث ان للرئيس صلاحيات إضافية واختصاصات أخرى يتمتع بها، تنص على أعمال المرؤوس فيباح للرئيس بأن يصدر أوامر ونواهي تتعلق بسير العمل، كما يتيح له تعديل ما يصدره المرؤوس من قرارات في حدود إختصاصه والتصديق عليها، هذا إلى جانب إنهاء تلك الأعمال بإلغائها أو سحبها، فضلا عن حقه في الحلول محل المرؤوس في إصدار قرار من إختصاصه. This study aims to shed light on the presidential authority in the Algerian public service law. In the first chapter, we touched on the concept and definition of the presidential authority, which is a legal relationship based on the concept of administrative subordination, the duty of obedience imposed on the subordinate towards his superior administrative leader, and the functional relationship between the employee and the administration. Disciplinary penalties to which the employee is subjected if he fails to perform the duties entrusted to him. As for the second chapter, we dealt with the powers of the presidential authority and the powers of the chief over the work of the subordinate, as the chief has additional powers and other powers that he enjoys. And ratification of them, in addition to the termination of those works by canceling or withdrawing them, as well as his right to replace the subordinate by issuing a decision within his jurisdiction
