تقنية تجميد الأجنة البشرية الفائضة وضوابط تطبيقها من وجهة شرعية وقانونية

Résumé: في إطار تطبيق عملية التلقيح الإصطناعي الخارجي يتم استخلاص عدد كبير من البويضات وذلك باستعمال أدوية منشطة ، غير أن هذا العدد من البويضات وبعد تخصيبها بالنطف الذكرية( الأجنة الزائدة) لا يتم زرعها في الرحم كاملة لدواعي صحية مرتبطة بالمرأة أو الأجنة ذاتها، ما يترتب عنه كنتيجة بقاء عدد منها دون استعمال ما دعا إلى التفكير في حفظها بطرق علمية وطبية بغرض إعادة استعمالها لاحقا خاصة في حالة عدم نجاح عملية الزرع الأولى وذلك عن طريق تقنية التجميد. غير أن هذا التجميد وإن كان قد تقرر لأهداف صحية مرتبطة بالمرأة وذلك بتجنيبها معاودة تجربة سحب البويضات وما يرتبط بها من إجراءات سابقة، إلا انه قد أفرز عن مظاهر سلبية جعلته محل معارضة ما دعا إلى تدخل المشرع لضبطه بقواعد صارمة سيما في الدول الاسلامية. الكلمات المفتاحية:تلقيح اصطناعي؛ بويضة مخصبة؛ أجنة فائضة؛ التجميد. Under the application of the external artificial insemination process, a large number of eggs are extracted using stimulant drugs. However, this number of eggs, after fertilization with male sperm (surplus embryos), are not implanted completely in the uterus for health reasons. related to the woman or to the embryos themselves, which results in the survival of a certain number of them without using what it was necessary to think about preserving them by scientific and medical methods in order to reuse them later , especially in the event that the first graft failed, thanks to the freezing technique. However, this freezing, although it was decided for health objectives related to the woman, avoiding her having to re-experience the egg retrieval and the previous procedures associated with it, but it resulted in negative aspects that made it the object of opposition, which called for the intervention of the legislator to control it with strict rules, especially in Islamic countries
