ولاية القضاء الوطني في المساءلة عن إنتهاكات القانون الدولي الإنساني

Résumé: إن الإختصاص بمتابعة ومعاقبة مرتكبي إنتهاكات القانون الدولي الإنساني يتقرر بصفة أولية للمحاكم الجنائية الوطنية، التي ينعقد لها الإختصاص إستنادا للمبادئ التقليدية المتمثلة في مبدأ الإختصاص الإقليمي، مبدأ الإختصاص الشخصي ومبدأ الإختصاص العيني. وقد يتوسع هذا الإختصاص فيشمل النظر في جميع الجرائم الدولية المرتكبة بغض النظر عن مكان وقوعها أو جنسية مرتكبيها وذلك إستنادا لمبدأ الإختصاص العالمي The jurisdiction to prosecute and punich the perpetrators of humanitarin Law is determined primarily by the national criminal courts to wich jurisdiction is based on the traditional principles, of territorial principle, nationality principle, and the protective priciple.
