علاقة الحق في الصحة مع الحق في الماء و الحق في البيئة دراسة في المواثيق الدولية و التشريع الجزائري

Résumé: Abstract : The right to health, or as it is also called the right to the enjoyment of the highest attainable standard of physical and mental health, is a fundamental human right recognized by both international and domestic laws. It is a state of complete physical, mental and social well-being and not merely the absence of disease or infirmity, as defined by the constitution of the World Health Organization (WHO). The right to health is closely linked to other human rights, such as the right to have a sufficient and safe quantity of drinking water ( the right to water), and the right to live in a safe environment ( the right to environment). This paper discusses the right to health and its relationship with the right to drinking water and sanitation and with the right to a safe environment in the light of the last constitutional amendment of the Algerian constitution and related provisions of Algerian and international legal documents. ملخص: الحق في الصحة، أو كما يسمى أيضا، الحق في التمتع بأعلى مستوى ممكن تحقيقه من الصحة الجسمية و العقلية، هو حق أساسي من حقوق الإنسان معترف به في كل من القانون الدولي و القوانين الداخلية. و هو حالة من اكتمال السلامة بدنيا و عقليا و اجتماعيا لا مجرد انعدام المرض أو العجز، حسب التعريف الذي أورده دستور منظمة الصحة العالمية. يرتبط الحق في الصحة ارتباطا وثيقا بحقوق إنسان أخرى، مثل الحق في الحصول على كميات آمنة و كافية من ماء الشرب ( الحق في الماء) و الحق في العيش في بيئة آمنة ( الحق في البيئة). يناقش هذا المقال العلاقة بين الحق في الصحة مع الحق في الحصول على الماء الصالح للشرب و الصرف الصحى، و مع الحق في البيئة الآمنة، على ضوء التعديل الدستورى الأخير في الجزائر و الأحكام ذات الصلة من التشريعات و المواثيق الجزائرية و الدولية.
