المادة السادسة عشر من اتفاقية سيداو وانعكاساتها على ولاية المرأة في قانون الأسرة الجزائري

Résumé: ملخص: تعتبر اتفاقية سيداو أكثر الاتفاقيات الدولية خطورة على الأسرة، فهي تمارس ضغوطا على الدول لتعديل قوانينها الداخلية حتى تتلاءم مع الاتفاقية، لذا عمد المشرّع الجزائري إلى تعديل التشريعات الداخلية متأثرا في ذلك بهذه الاتفاقية، فقد أقرّ في قانون الأسرة تمتّع المرأة بنفس ولاية الرجل، فأصبح لها حرية إبرام عقد زواجها بنفسها، وحق اختيار من يكون وليّا عليها، كما منحها حق الولاية على الأطفال القصّر سواء كانت أمًّا لهم أو غير أمٍّ، وسواء كانت الرابطة الزوجية قائمة أو منتهية. تهدف الدراسة إلى بيان مدى تأثّر المشرّع الجزائري باتفاقية سيداو في مسألة ولاية المرأة ومدى مساواتها مع الرّجل، وقد خلصنا من خلالها أنّ المشّرع الجزائري قد تأثّر تأثرا بالغا بنص المادة 16 من هذه الاتفاقية. Abstract: The CEDAW convention is considered the most dangerous convention for the family. it exerts pressure on states to amend their domestic laws to comply with the provisions of the convention. the Algerian Legislature has amended the domestic legislation influenced by this convention. the family code has established that women enjoy the same jurisdiction as men, so she has the freedom to conclude her marriage contract herself, and the right to choose who will be her guardian. it has also granted her the right of guardianship over minor children, whether they are their mother or not, and whether the marital bond is existing or dissolved. This study aims to explore how the Algerian legislator has been influenced by the CEDAW Convention, particularly concerning women's guardianship rights and their equality with men. The findings indicate that the Algerian legislator has been notably impacted by Article 16 of this convention.
