تكريس المنافسة والوقاية من الفساد في إبرام الصفقة العمومية

Résumé: تتمحور هذه الدراسة حول الحلول التي أوجدها المنظم من خلال المرسوم الرئاسي 15-247 المتضمن تنظيم الصفقات العمومية وتفويضات المرفق العام قصد تكريس مبادئ المنافسة و الحد من ظاهرة الفساد والوقاية منها، لاسيما في مرحلة الإبرام التي تعتبر أهم مرحلة في الصفقة العمومية، والتي يتم فيها اختيار المتعامل الاقتصادي وفق معايير تتماشى ومبادئ حرية الوصول للطلبات والمساواة في معاملة المترشحين وشفافية الإجراءات، حيث سنسعى إلى تقديم دراسة تحليلية وصفية لأهم الأحكام والإجراءات الواردة في هذا المرسوم الرئاسي، والتي من شأنها أن تلعب دورا مهما في الوقاية من الفساد و تطهير ميدان الصفقات العمومية من هذه الآفة، وخلق بيئة تنافسية مبنية على النزاهة و عقلانية التسيير و الحفاظ على المال العام. Abstract: This study revolves around the solutions created by the regulator through Presidential Decree 15-247 that includes the regulation of public deals and public utility mandates in order to perpetuate the principles of competition, reduce, and prevent corruption, especially in the conclusion stage, which is considered the most important stage in the public deal, in which selection is made. The economic operator according to standards that are in line with the principles of freedom of access to requests, equality in the treatment of candidates, and transparency of procedures, as we will seek to provide an analytical and descriptive study of the most important provisions and procedures contained in this presidential decree, which would play an important role in preventing corruption and purifying the field of public deals. From this scourge, and the creation of a competitive environment based on integrity and rational management and the preservation of public money.
