الرقابة الإدارية على الصفقات العمومية في ظل أحكام المرسوم الرئاسي15-247

Résumé: يعد موضوع الرقابة في مجال الصفقات العمومية من بين المسائل الحساسة لكونه يرتبط مباشرة بإحدى أوجه الإنفاق العمومي الذي بات في تزايد مستمر نظرا لتعدد مجالات تدخل الدولة في شتى الميادين ، لكن قد يصادف إبرام الصفقات العمومية مشاكل ومخاطر جمة قد ترهن تنفيذ المشاريع الهامة وتؤثر في نجاعة الطلبات العمومية وبالتالي تؤدي إلى تعطيل قيام الإدارة بنشاطها على أكمل وجه واضطلاعها بمهامها المختلفة لخدمة مصالح المواطنين وسير المرافق العامة. The issue of supervision in the field of public procurement is among the sensitive issues as it is directly related to one of the aspects of public spending, which is constantly increasing due to the multiplicity of areas of state intervention in various fields. However, the conclusion of public procurement may encounter many problems and risks that may contingent upon the implementation of important projects and affect the efficiency of requests. Public services and thus lead to the disruption of the administration's activities to the fullest and the discharge of its various tasks to serve the interests of citizens and the functioning of public utilities.
