النظام القانوني لبراءة الإختراع وفق القانون الجزائري

Résumé: ملخص: تعد براءة الإختراع نواة وجوهر الملكية الصناعية باعتبارها أداة لتحقيق التنمية الاقتصادية والتطور التكنولوجي، لذلك سعت جل التشريعات الدولية بتنظيمها في إطار قانوني محكم على غرار المشرع الجزائري الذي نظمها بموجب الأمر رقم 03-07 المتعلق ببراءات الإختراع، الذي يحدد الشروط الموضوعية والشكلية الواجب توافرها في الإختراع حتى يُستحق البراءة من طرف هيئة مختصة متمثلة في المعهد الوطني الجزائري للملكية الصناعية، مخولة لمالك البراءة جملة من الحقوق الإستئثارية ، بالمقابل تقع على عاتقه إلتزامات لا يمكنه التهرب منها، لأن ذلك من شأنه أن يؤدي إلى إنقضاء البراءة، وقد أقر المشرع الجزائري حماية قانونية لمالك براءة الإختراع في ظل التشريع الداخلي من خلال توفير آليات قضائية كدعوى المنافسة الغير المشروعة ودعوى جزائية تتمثل في دعوى التقليد، أما على الصعيد الدولي فإن براءة الإختراع تتمتع بالحماية أيضا وذلك من خلال الإنضمام إلى الإتفاقيات الدولية التي تعنى بحماية حقوق الملكية الصناعية. Abstract: Patents are considered the core and essence of industrial property as they are a tool for achieving economic development and technological advancement. The international legislations have sought to regulate them within a strict legal framework, similar to the Algerian legislator who organized it by virtue of Order No. 03-07 concerning patents, which specifies the objective and formal conditions that must be met in the invention in order for it to deserve a patent by a competent authority represented in the Algerian National Institute of Industrial Property. The owner of the patent is granted a set of intellectual rights. In return, he has obligations that he cannot evade, as this could lead to legal consequences. The Algerian legislator has established legal protection for the patent owner's will in the assembly under domestic legislation by providing the necessary legal space for the lawsuit of unfair competition and a criminal lawsuit represented in the imitation lawsuit. On the international level, the patent also enjoys protection through accession to international conventions concerned with the protection of industrial property rights. Résumé: Les brevets sont considérés comme le noyau et l'essence de la propriété industrielle car ils constituent un outil de développement économique et de progrès technologique. Les législations internationales ont cherché à les réglementer dans un cadre juridique strict, à l'image du législateur algérien qui l'a organisé en vertu de l'Ordonnance N° 03-07 concernant les brevets, qui précise les conditions objectives et formelles que doit remplir l'invention pour qu'elle mérite un brevet par une autorité compétente représentée à l'Institut National Algérien de la Propriété Industrielle. Le titulaire du brevet est. se voit accorder un ensemble de droits intellectuels. En contrepartie, il a des obligations auxquelles il ne peut se soustraire, car cela pourrait entraîner des conséquences juridiques. Le législateur algérien a établi une protection juridique de la volonté du titulaire du brevet dans le cadre de la législation nationale en prévoyant l'espace juridique nécessaire. pour le procès pour concurrence déloyale et un procès pénal représenté dans le procès en imitation. Au niveau international, le brevet bénéficie également d'une protection par l'adhésion aux conventions internationales concernées par la protection des droits de propriété industrielle.
