الطبيعة الخاصة لمهام الوسيط بين العمل القضائي والعمل الإداري

Résumé: يساهم الوسيط من خلال طبيعة العمل الموكل اليه في انجاح الوساطة ، حيث ان الوساطة في نهايتها اما ان تفضي الى تسوية ودية بين اطرافها ، او الفشل في الوصول الى تلك التسوية ، وفي كلتا الحالتين فان الوسيط يتولى ويقوم بالعديد من الاعمال بغية الوصول الى الحل المنشود ، وعمل الوسيط ، وعلى اختلاف انواع الوساطة سواء كانت قضائية ام خاصة ، ام اتفاقية يحتم ان يكون له طبيعة قانونية ، وهذا يثير عدة تساؤلات هل ان عمل الوسيط هو عمل قضائي ، ام انه موازي للعمل القضائي ، وخصوصا اذا ما اخذنا بالحسبان ان العمل الاجرائي والذي يشكل جزءاً لا يتجزأ من الخصومة القضائية ، بمجرد صدوره يرتب اثرا اجرائيا مباشرا لا يصدر فقط من القضاة بل من الغير ايضا ، وقد يكون هذا الغير هو الوسيط ، فضلا عن ذلك فان بعض التشريعات اشترطت ان يكون الوسيط موظفاً عموميا ليتولى مهمة التوسط فيما بين المتخاصمين في بعض المنازعات المدنية والتجارية ، ام ان تردد طبيعة مهمة الوسيط بين العمل القضائي والاداري يحتم منح مهمة الوسيط طبيعة خاصة. The mediator contributes through the nature of the work that entrusted to him in the success of the mediation, the mediation at the end either leads to an peaceful settlement between its parties, or failure to arrive to the settlement, and in both cases the mediator takes and makes many of the work in order to reach the desired solution, and the work of the mediator, and the different types of mediation, whether judicial or private, or an agreement must be a legal nature, and this raises several questions whether the work of the mediator is a judicial action, or is parallel to the judicial work, especially that the procedural work, which constitutes an integral part of the litigation, as soon as moreover, some legislations stipulated that the mediator should be a public servant to assume the task of mediating between the litigants in some civil and commercial disputes, or that the frequency of nature the task of the mediator between the judicial and administrative work necessitates granting the mediator's task a special nature.
