ظاهرة القتل الرحيم بين مقاصد الرحمة والعدل في الشريعة الإسلامية The Phenomenon Of Euthanasia Between The Purposes Of Mercy And Justice In Islamic Sharia

Résumé: تقف الإنسانية اليوم أمام ظاهرة القتل الرحيم الذي يدعو إلى الرحمة بالمريض الميؤوس من شفائه، بإزهاق روحه بطريقة يسيرة لاشقاء فيها، ولما كانت الشريعة الإسلامية شريعة شاملة لكل الجوانب الحياتية، فمن أهم ما عنيت به حفظ النفس الذي يعد من أهم المقاصد الضرورية للشريعة الإسلامية، جاءت هذه الدراسة للوقوف على ظاهرة القتل الرحيم، والتأصيل لمقاصد الرحمة والعدل، والموازنة بينهما لاستخلاص الحكم الشرعي المناسب . وبعد التأكيد على أن ظاهرة القتل الرحيم اتخذت أبعادا متعددة، وأن مقصد الرحمة معتبر في الشريعة الإسلامية ومرتكزة على العاطفة والوجدان احتاج إلى مقصد العدل الذي أكدته النصوص الشرعية أيضا لضبط الحقوق وصيانتها، لكن قد يعتبر مقصد الرحمة في مسألة القتل بالنسبة لغير معصوم الدم وفيما ليس فيه اعتداء على الحقوق التي كفلتها الشريعة الإسلامية. Abstract: Today, humanity stands in front of the phenomenon of euthanasia, which calls for mercy to the terminally ill by taking his soul in an easy and unhurried manner. Since the Islamic Sharia is a comprehensive law for all aspects of life, one of the most important things I have concerned with is self-preservation, and rooting for the purposes of mercy and justice, and balancing between them to derive the appropriate legal ruling. And after emphasizing that the phenomenon of euthanasia has taken on multiple dimensions and that the goal of mercy is considered in Islamic law and is based on emotion and conscience, it needs the goal of justice, which is also confirmed by Sharia texts to control and maintain rights, So it became clear to us that the legality of the purpose of mercy does not mean an infringement of the right to life as long as the person is infallible blood. Justice requires the protection of oneself from everything that oppresses it unjustly. But the purpose of mercy in the matter of murder may be considered in relation to the infallible blood, and in what is not a transgression of the rights guaranteed by Islamic Sharia.
