جريمة المطرقة الغابية في التشريع الجزائري

Résumé: لاشك أن موضوع الحماية القانونية للملكية العقارية الغابية موضوع بالغ الأهمية، لأن قيمة وأهمية هذه الملكية العقارية لا تقاس بكميتها ومساحتها، بل تقاس بقدر الحماية المنوطة بها، والجزائر على غرار باقي دول العالم، وحرصا منها بضرورة الحفاظ على هذه الثروة المتجددة، سعى المشرع الجزائري لوضع نصوص ردعية عقابية لكل متعد على الأملاك الغابية، فقد أحاطها بحماية جزائية واسعة وجرم الكثير من أعمال التعدي التي قد تلحقها، فتناول مبدأ التجريم والعقاب بموجب قانون العقوبات باعتباره الإطار التجريمي والعقابي الأساسي لجرائم التعدي على الأموال المنقولة أو العقارية، والتي تندرج تحتها الأملاك الغابية، وتعتبر جريمة المطرقة الغابية من جرائم الاعتداء على الثروة الغابية التي تمت دراستها في هذه المقالة لتبيان الحماية الجنائية المرصودة لها في جانبها الموضوعي و الإجرائي. There is no doubt that the issue of legal protection for forested real estate is a very important topic, because the value and importance of this real estate ownership is not meas ured by its quantity and area, but is measured by the extent of the protection entrusted to it. Punitive deterrent texts for every trespasser on forest property, as he surrounded it with broad penal protection and criminalized many acts of infringement that may inflict on it. He addressed the principle of criminalization and punishment under the Penal Code as the basic criminal and punitive framework for crimes of infringement on movable or real property, under which forest property falls. The crime of the forest hammer is one of the crimes of assault on the forest soil that has been studied in this article to show the criminal protection for it in its substantive and procedural aspect.
