أحكام نظرية الظروف الطارئة في العقود الإلكترونية

Résumé: ملخص: تهدف نظرية الظروف الطارئة إلى إعادة التوازن الاقتصادي للعقد، فبمجرد أن تختل الالتزامات المتقابلة للمتعاقدين فيبرز دور نظرية الظروف الطارئة، ولعل استخدام البيئة الإلكترونية عند التعاقد، استحدث عقود تسمى بالعقود الإلكترونية، تبرم عن بعد باستخدام البيئة الإلكترونية، مستغلة بذلك شبكة الإنترنت. حيث نسلط الضوء في هذه الدراسة على تطبيقات نظرية الظروف الطارئة على العقود الإلكترونية، من خلال إبراز هذه العقود ومدى مواءمتها لشروط نظرية الظروف الطارئة، التي تهدف بالأساس إلى تعديل الالتزامات التعاقدية المتقابلة إلى الحد المعقول، ورفع الضرر عن الطرف المتأثر بها. Abstract: The theory of emergency conditions aims to restore the economic balance of the contract, as soon as the corresponding obligations of the contracting parties are disturbed, the role of the theory of emergency conditions emerges, and perhaps the use of the electronic environment when contracting created contracts called electronic contracts concluded remotely using the electronic environment, taking advantage of the Internet. In this study, we shed light on the applications of the theory of emergency conditions on electronic contracts, by highlighting these contracts and their compatibility with the conditions of the theory of emergency conditions, which mainly aim to modify the corresponding contractual obligations to a reasonable extent, and to remove the damage from the affected party.
