المسؤولية الإدارية الخطئيّة للمرافق الاستشفائية عن التلوث بفعل النفايات الطبية

Résumé: تلعب المرافق الاستشفائية دورا في حماية البيئة إلى جانب نشاطها الأساسي المتمثل في تقديم الخدمات الصحية، وذلك عن طريق التزامها بتسيير النفايات الطبية الخطرة على البيئة. ومنه تطرح الإشكالية المتمثلة في مدى مسؤولية المرافق الاستشفائية نتيجة أخطائها المرتكبة في عملية تسيير النفايات الطبية الملوثة للبيئة؟ ومن أجل الإجابة على هذه الإشكالية تم التطرق في النقطة الأولى إلى التعريف بالتلوث البيئي بفعل النفايات الطبية، ثم في النقطة الثانية تم الحديث عن عناصر قيام المسؤولية الإدارية الخطئيّة للمرافق الاستشفائية عن التلوث البيئي بفعل النفايات الطبية. حيث تبين لنا أن ليس كل النفايات الطبية تكون خطرة على البيئة إلا إذا لم يتم تسييرها بطريقة خاصة أو اشتملت على مواد سامة؛ على أن المشرع الجزائري لم يضع أحكاما خاصة بالمسؤولية الإدارية الخطئية لهذه المرافق نتيجة عدم امتثالها للالتزامات المفروضة عليها قانونا والمتعلقة بتسيير النفايات الطبية الخطرة على البيئة، وبذلك يتم الرجوع إلى أحكام المسؤولية المدنية الواردة في القانون المدني. Hospital services play a role in protecting the environement witheir primary activity of proviting service, through their commitment to the management of medical waste hazardous to the environment. And from it raises the problem of the extent of responsibility of hospital services as a result of mistakes committed in the process of managing medical waste that polluttes the environment ? In order to answer this problem, first, the definition of environmental pollution caused by medical waste. the elements of the faulty administrative responsibility of hospital services for the environmental pollution caused by medical waste were discussed. As we found out that not all medical waste dangerous to the environment unless it is not managed in a special way or contains toxic substances; However, the Algerian legislator did not lay down provisions for the faulty administrative responsibility of these services as a result of their non-compliance with the obligations imposed on them by law related to the management of medical waste hazardous to the environment, thus referring to the provisions of civil responsibility contained civil code.
