مبدأ حرية المقاولة في الدستور الجزائري
Résumé: يعد مبدأ حرية المقاولة من بين أهم المبادئ المستحدثة في المادة 61 من دستور 2020، فهو إعلان من المشرع الدستوري على الاستمرار في سياسة التوسع في المجال الاقتصادي بل وأبعد من ذلك بما أن مجال المقاولة يتسع ليشمل جميع قطاعات النشاط الخاص تقريبا، وعليه توجب البحث حول المفهوم الدقيق لمصطلح المقاولة المقصود من النص الدستوري وتحديد حدود وضوابط هذا المفهوم في مواجهة الإدارة وفي مواجهة باقي الحقوق والحريات الأساسية والعامة في الدستور. The principle of freedom of enterprise is among the most important principles developed in Article 61 of the 2020 Constitution, it is necessary to research the concept the exact term “enterprise” is meant by the constitutional text and defines the limits and controls of this concept in the face of the administration and in the face of the rest of the basic rights in the constitution.
