إجبارية إستعمال وسائل الدفع كآلية للرقابة على المعاملات المالية نحو الخارج

Résumé: أمام تزايد حركة الإنتقال عبر الحدود في يسر وكثرة، بقصد التجارة أو السياحة أو غير ذلك، ظهرت الحاجة إلى تسديد فواتير السلع والخدمات عند كل طلب لها؛ ولمّا كان حمل النقود إلى الخارج تكتنفه مخاطر عديدة، وتحوط به إجراءات قانونية صارمة تعرقل تداوله بحرية، لم يكن أمام المتعاقدين سوى اللجوء إلى مطالبة المصارف ببدائل تتماشى مع متطلّبات التجارة الخارجية ومخرجاتها، فكانت وسائل الدفع. وحماية للإقتصاد الوطني من أي تلاعبات أو تحويلات غير شرعية للأموال إلى الخارج، فرض المشرع على المتعاملين في مجال التجارة الخارجية إجبارية إستعمال وسائل الدفع في عمليات التجارة الخارجية. In light of the increasing movement on the borders for the purpose of trade, tourism or otherwise, the need to pay bills for goods and services across with every request for them. Since carrying money abroad is fraught with many risks and is surrounded by strict legal procedures, the contractors had no choice but to ask the banks for alternatives consistent with the requirements of foreign trade, which were the means of payment. In order to protect the national economy from any manipulation or illegal transfer of funds abroad, the legislator imposed on dealers in the field of foreign trade the mandatory use of payment methods in foreign trade operations.
