صلاحيات رئيس هيئة التحكيم

Résumé: إن نظام التحكيم يعطي للمحتكمين الحق في اختيار عدد المحكمين المنوط لهم مهمة الفصل في النزاع. فإذا تشكلت هيئة التحكيم بأكثر من محكم، وجب تعيين محكم يتولى رئاسة الهيئة. ومما لاشك فيه أن لرئيس الهيئة دور محوري في ضمان تسوية النزاع بشكل فعال وفي الوقت المتفق عليه من قبل الأطراف. ولهذا تم الاعتراف لرئيس هيئة التحكيم بصلاحيات واسعة مقارنة بالمحكمين المشاركين له في العملية التحكيمية، بدءا من انعقاد الاختصاص للهيئة والسير في الخصومة التحكيمية بما تتطلبه من ضبط للجلسات والمرافعات المقدمة واتخاذ القرارات الإجرائية اللازمة ،وصولا إلى إصدار الحكم التحكيمي. In arbitration, the parties are free to appoint more than one arbitrator for the settlement of the dispute. If the tribunal is to consist of three arbitrators, the third arbitrator as the Presiding arbitrator or the Chairman of the tribunal. The role of the Presiding arbitrator is pivotal because he considered at all stages of an arbitration. He may decid any questions of procedure, and control and conduct the hearings. The Presiding arbitrator shall supervising all such pleadings submitted by both parties Moreover, the view of the Presiding arbitrator shall prevail in relation to any decision or award in respect of which there is no majority.
