قبض رأس مال السَّلم في مجلس العقد دراسة فقهية مقارنة

Résumé: الملخص: انطلاقاً من أن السَّلم في عصرنا الحاضر أداة تمويل ذات كفاءة عالية في الاقتصاد الإسلامي وفي نشاطات المصارف الإسلامية، من حيث مرونتها واستجابتها لحاجات التمويل المختلفة، واستجابتها لحاجات شرائح مختلفة ومتعددة من العملاء، كان دراسة "قبض رأس مال السَّلم في مجلس العقد- دراسة فقهية مقارنة" من الأهمية بمكان. فبينت في هذا البحث معنى السَّلم ورأس مال السلم ومعنى مجلس العقد فيه، ثم أكدت على مشروعية السلم، ثم انتقلت إلى بيان حكم اشتراط قبض رأس مال السَّلم في مجلس العقد، ومدى الاختلاف فيه، في أقوال الأئمة المعتبرين، ثم مسائل فقهية تطبيقية تنبني على مسألة اشتراط قبض رأس مال السَّلم في مجلس العقد، وخلصت إلى نتائج هامة ذكرتها في آخر البحث. Abstract: Proceeding from the fact that Salam in our time is a highly efficient financing tool in the Islamic economy and the activities of Islamic banks, in terms of its flexibility and response to different financing needs, and its response to the needs of different and multiple segments of clients, the study was “Receipt of Salam Capital in the Contract Council - A Comparative Jurisprudential Study” " It is important. So I explained in this research the meaning of Salam and Salam capital and the meaning of the contract council in it, then confirmed the legitimacy of Salam, then moved to a statement of the ruling on the receipt of the Salam capital in the contract council, and the extent of the difference in it, in the sayings of the respected imams, and then applied jurisprudential issues based on the issue The requirement to receive the Salam capital in the contract council, and I concluded important results that I mentioned at the end of the research.
