التعويض عن جريمة القتل الخطأ في المذهب المالكي والتشريع الجزائري

Résumé: "ملخص: تم تناول موضوع التعويض عن جريمة القتل الخطأ في المذهب المالكي والتشريع الجزائري ولدراسته تم طرح الإشكال التالي: كيف يكون التعويض عن جريمة القتل الخطأ في الفقه المالكي والتشريع الجزائري؟ وللإجابة عن هذا الإشكال تم تقسيم هذه الدراسة إلى مقدمة وفصلين وخاتمة حيث تم تخصيص الفصل الأول حول القتل الخطأ والتعويض بين المذهب المالكي والتشريع الجزائري، والذي بدوره تم تقسيمه إلى مبحثين، تم تناول في المبحث الاول ماهية القتل الخطأ في المذهب المالكي والتشريع الجزائري، وتم التطرق في المبحث الثاني إلى ماهية التعويض في المذهب المالكي والتشريع الجزائري، أما الفصل الثاني فقد تم التناول فيه كيفية التعويض في المذهب المالكي والتشريع الجزائري، والذي تمت درسته في مبحثين أيضا، تم طرح في المبحث الأول كيفية التعويض في المذهب المالكي، اما المبحث الثاني تم تناول كيفية التعويض في التشريع الجزائري، ولدراسة هذا الموضوع تم الاستعانة ببعض المناهج العلمية أولها المنهج الوصفي كون الموضوع يتطلب نقل الاقوال والآراء والأدلة في المسألة إضافة إلى المنهج التحليلي في مناقشة تلك الآراء وترجيحها وتم الاعتماد أيضا المنهج المقارن حيث كان مجالها المذهب المالكي والتشريع الجزائري، ومن بين أهم النتائج التي تم التوصل إليها أن الدية و الكفارة هي العقوبات الأصلية في المذهب المالكي وهذه العقوبات غير مذكورة في التشريع الجزائري و إن التشريع الجزائري خالف الشريعة الإسلامية، ومن بين المقترحات رأينا انه من الأفضل أن يتم تعديل القانون بالنص على الكفارة والدية كعقوبة لهذه الجريمة بما يتفق مع ما أوجبته الشريعة الإسلامية في هذا الخصوص. ""Abstract: The study was dealt with the issue of compensation for the crime of manslaughter in the Maliki doctrine and Algerian legislation, the following problem was raised: How is compensation for the crime of manslaughter in the Maliki jurisprudence and Algerian legislation? In order to answer it study was divided into an introduction, two chapters and a conclusion, where the first chapter was devoted to wrongful killing and compensation between the Maliki doctrine and Algerian legislation, which in turn was divided into two sections. In the second topic to the nature of compensation in the Maliki doctrine and Algerian legislation, while the second chapter has dealt with how compensation in the Maliki doctrine and Algerian legislation, which was studied in two sections as well. How to compensate in Algerian legislation, and to study this topic, some scientific methods were used, the first of which is the descriptive approach, since the topic requires the transfer of sayings, opinions and evidence in the matter, in addition to the analytical method in discussing and weighing those opinions. The most important results that have been reached are that blood money and penance are the original penalties in the Maliki school of thought, and these penalties are not mentioned in the specific legislation. I see that the Algerian legislation violated the Islamic Sharia, and among the proposals, we saw that it would be better to amend the law by providing for penance and blood money as a punishment for this crime in accordance with what Islamic Sharia requires in this regard.
