الحـق فـي البيئـة كحق من حقوق الإنسان

Résumé: أدى التقنين الدولي لحقوق الإنسان مؤخرا إلى ظهور حقوق تدخل في قائمة حقوق الإنسان وحقوق الشعوب في آن واحد، وتشمل الحق في البيئة، الحق في ملكية التراث المشترك الإنسانية، الحق في التنمية، الحق في السلم. فهذه الحقوق إذا نظرنا إلى المستفيدين منها وإلى طريقة ممارستها وإلى الحماية التي تقررها، نجدها تجمع بين صفة الحقوق الفردية، وصفة الحقوق الجماعية فضلا عن الروابط والعلاقات المتبادلة التي تجمع بين هذه الصفة وتلك. ولذلك ارتأينا معالجة حق من هذه الحقوق ألا وهو الحق في البيئة، الذي يعتبر أحد حقوق الإنسان وهو يتميز بخصائص نوعية تتجاوز نطاق حقوق الإنسان الأخرى، وله مضمون يكتسب ثراء بانتمائه إلى نمط جديد من العلاقات الدولية. The international legalization of human rights has recently led to the emergence of rights that are included in the list of human and peoples' rights simultaneously, and include the right to the environment, the right to own the common heritage of humanity, the right to development, and the right to peace. These rights, if we look at the beneficiaries of them, the method of exercising them, and the protection they decide, we find that they combine the characteristic of individual rights, the characteristic of collective rights, as well as the interrelationships and interrelationships that combine this quality with that. Therefore, we decided to address one of these rights, which is the right to the environment, which is considered a human right and is characterized by specific characteristics that go beyond the scope of other human rights, and which has a content that acquires richness by its belonging to a new type of international relations.
