قياس الشبه عند الأصوليين دراسة تأصيلية تطبيقية

Résumé: تناول البحث قياس الشبه وهو نوع من أنواع الاجتهاد القياسي؛ وقد أخذ نصيبا كبيرا من الدراسة عند الأصوليين؛ من حيث التعريف والأنواع وكذا الخلاف في حجيته، وكثرة الفروع الفقهية المنبنية عليه والنوازل الفقهية؛ مما يدل على أهميته، وجعلته في ثلاثة مباحث؛ الأول: في مفهوم قياس الشبه؛ وتضمن الخلاف في مناهج تعريفه، و بينت أنواعه، والفرق بينه وبين الألفاظ ذات الصلة؛ كقياس الدلالة والطرد والمناسبة وتحقيق المناط، أما الثاني فعقدته لحجية القياس، وفرعت على القول به وهو الصحيح من القولين ما ما اعتبر من الأقيسة الشبهية، ثم في ترتيب قياس الشبه مع سائر الأقيسة، وأما المبحث الثالث فجعلته للآثار الفقهية المترتبة على الخلاف في قياس الشبه، وذلك في العبادات والمعاملات والجنايات، وبعض القضايا المعاصرة. The research dealt with analogy, which is a type of standard ijtihad. It has taken a large share of the study of the fundamentalists; In terms of definition and types, as well as the dispute over its authority, and the large number of jurisprudential branches based on it and jurisprudential calamities; Which indicates its importance, and made it into three sections; The first: in the concept of analogy; It included the controversy in the methods of defining it, its types, and the difference between it and related terms; As the measurement of significance, expulsion, appropriateness, and the realization of the predicate. As for the second, I held it to the authority of the analogy, and I branched out on saying it, and it is the correct of the two sayings, what was considered from the analogous measures, then in the arrangement of the analogy measurements with other measures, and as for the third topic, I made it for the jurisprudential effects resulting from the dispute in the analogy, And that in worship, transactions, felonies, and some contemporary issues.
