أثر التوسع العمراني والمنشآت الهندسية الكبرى على الممتلكات الثقافية العقار ية − القضايا المعالجة من طرف الدرك الوطني أنموذجا −
Résumé: شرعت السلطات العمومية بالجزائر خلال الفترة الأخيرة في إنجاز الكثير من المشار يع العمرانية التي ساهمت، بالرغم مما حققته من إيجابيات على صعيد التنمية، في التأثير السلبي على حالة المواقع الأثر ية. من هذا المنطلق يهدف هذا البحث إلى تشريح ظاهرة التعدي على الممتلكات الثقافية العقار ية من خلال محاضر الدرك الوطني. يتمحور البحث في جزء كبير منه حول مخالفات قانونية، لذلك ركزنا على التعر يف القانوني للمصطلحات، كما استعرضنا الأجهزة والمؤسسات الدولية والوطنية المكلفة بتسيير وحماية التراث الثقافي، فضلا عن أسباب تدهور النسيج الثقافي العقاري بالجزائر بالشرح والتحليل. درسنا أيضا وفق منهج إحصائي وتحليلي القضايا المسجلة حسب المناطق والفترات التاريخية التي تنتمي إليها المواقع الأثر ية، أسباب وطبيعة الأشخاصالمعتدين، درجة الضرر وصنفالحماية القانونية المطبقة. سجلنا من خلال البحث استفحال المساس بالممتلكات الثقافية العقار ية بالجزائر بفعل متطلبات التنمية. يكمن الحل المقترح في تطبيق مخططات التوجيه العمراني التي أقرها المشرع الجزائري على غرار المخطط التوجيهي لحماية المناطق الأثر ية والتاريخية 2007 ، وكذا الاستفادة من تجارب الدول التي نجحت في المزاوجة بين معضلتي التنمية والحفاظ على التراث الثقافي. The Algerian authorities have accomplished recently many urban projects. These projects have indeed contributed in development but had a negative impact on the state of estate archeological sites. From this standpoint, this project (thesis) aims at disserting the phenomenon of encroachment on cultural property in Algeria through the records of judiciary police. Considering that the project focuses greatly on the legal transgressions, we focused on the legal definition of terminology and on the national and international bodies and institutions charged with the management and protection of cultural heritage. We also studied by explaining and analyzing the reasons for the deterioration of the real estate cultural fabric in Algeria. We also dealt with, according to statistical and analytical approaches, the cases registered according to the regions and historical periods to which the archeological sites, causes of aggressors, degree of damage and class of legal protection. Through this project, we have recorded the exacerbation of prejudice to the real estate cultural heritage, because of the development requirements in light of financial recovery. The suggested solution lies in the application of urban orientations along with lines of the master plan for the protection of archeological and historical areas. It also benefits from the experiences of countries that have succeeded in combining the two dilemmas of development and preservation of cultural heritage.
