التعويض التلقائي عن الأضرار اللاّحقة بضحايا الحوادث الطبية (صندوق الضمان الفرنسي نموذجا)

Résumé: أمام عجز قواعد المسؤولية التقليدية عن تعويض المضرورين عن الأضرار الناتجة عن الحوادث الطبية استحدث المشرع الفرنسي نظام جديد مبني على الطابع الاجتماعي يهدف إلى تعويض المضرورين عن المخاطر الطبية الواقعة خارج نطاق الخطأ الطبي، عن طريق صندوق الضمان الفرنسي، إذ يحمي المضرورين في حالة توافر مجموعة من الشروط وإتباع مجموعة من الإجراءات للحصول على التعويض، فنقل هذا الصندوق عبء التعويض من المسؤول محدث الضرر إلى ذمة الجماعة. Abstract : Faced with the inability of the traditional liability rules to compensate the injured for the damages resulting from medical accidents, the French legislator created a new system based on the social nature aimed at compensating the injured for the medical risks outside the scope of the medical error, through the French guarantee fund, as it protects the injured in the event of a group Among the conditions and following a set of procedures to obtain compensation, this fund transferred the burden of compensation from the official who caused the damage to the group responsibility .
