قواعد التجريم والعقاب في جريمة الإتجار بالأشخاص

Résumé: إن ما تشكله جريمة الإتجار بالأشخاص من تهديد للأمن الشخصي للأفراد والجماعة البشرية،والحيلولة دون تمتعهم بحقوقهم وتأثيرها على عملية التنمية الاجتماعية للدول خاصة منها الدول النامية، تتطلب ضرورة اتخاذ إجراءات خاصة تتناسب مع الإمكانيات التي تمتلكها عصابات الإتجار بالأشخاص ،و التي تتخذ من ممارسة الأنشطة غير المشروعة مهنة تحترفها وتمارسها ببراعة متناهية وفق أسلوب علمي يعتمد على التخطيط بدقة، والتنفيذ بمستوى عالي من التقنيات، وعليه تثار العديد من المسائل بشأن جريمة الاتجار بالأشخاص سواء من حيث التجريم أو من حيث العقاب و الإجراءات باعتبار أن مبدأ الشرعية ينظم الميدان الجزائي بكل فروعه،إلا أن هذه الورقة البحثية ستقتصر على البحث في جريمة الاتجار بالأشخاص في مجال التجريم والعقاب . Abstract: The crime of trafficking in persons poses a threat to the personal security of individuals and the human community, and to prevent them from enjoying their rights and its impact on the process of social development of countries, especially developing countries, this need to take special measures commensurate with the capabilities of trafficking in persons that take from the practice of illegal activities A profession and professionally practiced according to a scientific method based on careful planning and implementation with a high level of technology, and accordingly many issues arise regarding the crime of trafficking in persons, whether in terms of criminalization or in terms of punishment and procedures given that the principle of legality regulates the penal field in all its branches, except that This research paper will be limited to researching the crime of trafficking in persons in the area of criminalization and punishment.
