مبدأ الفصل بين السلطات على ضوء التعديل الدستوري2020 ''فصل مطلق أم توازن وتعاون بين السلطات؟''

Résumé: تهدف هذه الدراسة إلى بيان موقف الدستور الجزائري من مبدأ دستوري شهير تعتنقه أغلب الديمقراطيات الحديثة ألا وهو مبدأ الفصل بين السلطات، الذي عرف تطبيقه تضاربا في التجربة الدستورية الجزائرية، بسبب عزوف المؤسس الدستوري عن الأخذ به تارة، واقراره ضمنا تارة أخرى، ثم تبنيه صراحة في اخر تعديل دستوري عرفته الجزائر. وتزامنا مع التعديل الدستوري الأخير لسنة 2020، ارتأينا تحليل النص الدستوري المتعلق به للتعريف بالمبدأ وبيان عناصره وتحديد طبيعة الفصل المقام بين السلطات ومظاهره. This study aims to clarify the position of the Algerian constitution on a well-known constitutional principle embraced by most modern democracies, which is the principle of separation of authorities , whose application was known to be inconsistent in the Algerian constitutional experience, due to the constitutional founder’s reluctance to adopt it at one time, and implicitly endorse it at other times, and then adopt it explicitly. In conjunction with the last constitutional amendment of 2020, we decided to analyze the constitutional text related to it to define the principle, clarify its elements, and determine the nature and manifestations of the separation of authorities.
