Résumé: ملخص: لطالما سعى المجتمع الدولي إلى إنشاء قضاء دولي جنائي لمتابعة مرتكبي الجرائم الدولية، وفي سبيل ذلك مر بالعديد من المحاولات بدء من محاكم الحرب العالمية الثانية لكل من نورمبورغ وطوكيو، لتليهما محكمتا يوغوسلافيا ورواندا المنشئتان بموجب قرار من مجلس الأمن في إطار الفصل السابع من ميثاق الأمم المتحدة، وظلت هذه المحاولات إلى غاية 1998 أين تم بعث المحكمة الجنائية الدولية كأول جهاز قضائي دائم، يختص بمتابعة مرتكبي الجرائم الدولية الأكثر خطورة سعيا لتحقيق العدالة الجنائية الدولية والتي دخلت حيز النفاذ سنة 2002. إلا أن المجتمع الدولي لم يكتف عند هذا الحد بل لجأ إلى استحداث محاكم دولية جنائية خاصة بتدخل من الأمم المتحدة على غرار محكمتي سيراليون ولبنان الخاصتين، مبررا ذلك بسبب القيود الواردة على النظام الأساسي للمحكمة الجنائية الدولية خاصة فيما يتعلق بالاختصاص. : بعث، ، ، مبرر.
