امتيازات إدارة الجمارك في الدعوى الجبائية

Résumé: بوقوع الجريمة الجمركية في الدولة، ينشئ حق المجتمع في توقيع العقاب وهو أمر لا نقاش فيه، لكن تأخذ الإدارة الجمركية فيها مركز الضحية، فينشأ حقها كذلك في استيفاء الحقوق والرسوم الجمركية، وذلك عن طريق ممارسها لدعوى خاصة تسمى بالدعوى الجبائية، والتي تختلف عن الدعوى المدنية بالتبعية، تملك من خلالها الإدارة الجمارك عدة امتيازات وسلطات غير مألوفة تتمثل في منح المشرع للجمارك التدخل في تحريك هذه الدعوى ومباشرتها بنحو تتقاسم فيه المتابعات مع النيابة العامة، وتتدخل في تقدير نتائجها وهي الجزاءات الجبائية المتمثلة في الغرامة والمصادرة وتمارس صلاحيات واسعة من الناحية العملية من اجل تنفيذ هذه الجزاءات كممارسة إجراءات التحقيق عن الملاءة وإصدار إعلان الأبحاث العامة وإنهاء الدعوى الجبائية عن طريق المصالحة وفق ما ينص عليه القانون الجمركي، مما يؤكد في كل مرة مركزها الممتاز في المنازعة الجمركية مقارنة مع مركز خصمها وهو الشخص المخالف في سبيل حماية مصالح الخزينة العامة. With the occurrence of a customs crime in the state, the right of society to impose punishment is established, which is indisputable, but the customs administration takes the status of the victim, so its right to fulfill customs rights and fees also arises, through the exercise of a special lawsuit called the tax lawsuit, which differs from the civil lawsuit by extension, through which the customs administration has several broad powers in practice for the implementation of such sanctions as an exercise The procedures for investigating solvency, issuing a public research declaration and ending the tax case through reconciliation as provided for by the customs law, which confirms each time its excellent position in the customs dispute compared to the position of its opponent, the offending person, in order to protect the interests of the public treasury.
