فعالية نظام المسؤولية الدولية في حماية البيئة من التلوث

Résumé: يناقش هذا البحث موضوع المسؤولية الدولية عن الأضرار البيئية في ضوء أحكام القانون الدولي العام ذات الصلة، ونهدف من خلاله إلى توضيح مدى فعالية وكفاية نظام المسؤولية في حماية البيئة من التلوث، باعتبارها الحارس الذي يسعى إلى ضمان واحترام القانون، فلا شكّ أن المسؤولية تلعب دوراً هاماً وحاسماً في مجال حماية البيئة، وذلك أنّ أية حماية للبيئة لا يمكن أن تكون فعّالة إلاّ بوضع نظام للمسؤولية يحقّق الردع والإصلاح في ذات الوقت. This paper discusses the topic of international liability for environmental damage in the light of relevant provisions of public international law. We aim through it to clarify the effectiveness and adequacy of the system of responsibility in protecting the environment from pollution. As a guard, which seeks to ensure respect for the law, there is no doubt that the responsibility plays an important and decisive role in the field of environmental protection, so that any protection of the environment cannot be effective unless a system of responsibility is established in order to achieve deterrence and reform at the same time.
