المحكمة الجنائية الدولية بين الإختصاص القائم و معوقات الإنعقاد

Résumé: ملخص: ظهور جرائم خطيرة على الساحة الدولية كجرائم الحرب و الجرائم ضد الإنسانية أدى إلى ضرورة إنشاء جهة قضائية على المستوى الدولي يوكل لها الإختصاص بالفصل في هته الجرائم التي تكتسي خطورة و هي المحكمة الجنائية الدولية التي ليست لها الصفة المؤقتة و لا الإختصاص المحدد زمنيا، بروز المحكمة الجنائية الدولية جاء من خلال إقرار نظام روما سنة 1998 و هي الجهة ذات الولاية أو الإختصاص المكمل للإختصاص القضائي الوطني، كما أن فيه حالات تحل محل الجهات القضائية الوطنية إذا انهار ذلك الجهاز مثل حالات الحرب أو العدوان أو الإحتلال، لكن هل ينعقد اختصاص المحكمة الجنائية الدولية في جميع الحالات ؟ أم أن فيه إجراءات معينة تقيد من اختصاص ذات المحكمة، و حتى معوقات تحول دون انعقادها. : Summary The emergence of serious crimes on the international scene, such as war crimes and crimes against humanity, has led to the need to establish a judicial body at the international level which would have jurisdiction to judge these crimes in a particular gravity, which is the International Criminal Court, which has neither temporary status nor time-limited jurisdiction, the emergence of the court The International Criminal Court came through the adoption of the Rome Statute in 1998, and it is the body endowed with jurisdiction or competence that supplements the national jurisdiction, and there are cases that replace the national judicial authorities if this apparatus breaks down, such as cases of war, aggression or occupation, but does the jurisdiction of the International Criminal Court take place in all cases, or are there certain procedures that restrict the jurisdiction of the same court, and even obstacles that prevent its convocation.
