التزام مجهز السفينة بضمان سلامة البحار وترحيله

Résumé: بحكم أن البحار يمارس عمله على متن السفينة، فإن هذا يجعل هذا العمل يتسم بطابع خاص لأنه يتم في بيئة خاصة، وكون محيط ممارسة مهامه محفوف بالمخاطر من جهة ويحتم عليه الابتعاد عن موطنه من جهة أخرى، فإن هذا يلقي على عاتق المجهز التزاما مزدوجا أي ضمان سلامته وكذا ترحيله لموطنه. لهذا نهدف من وراء بحثنا هذا إبراز أهمية هذا الالتزام وضرورته من أجل سيرورة العمل البحري على أكمل وجه، كما نبتغي أن نوضح المدى الذي يصل إليه و خصوصيته متبعين في ذلك منهجا تحليليا. : Abstract By virtue of the fact that the sailor exercises his work on board the ship, this makes this work of a special character because it takes place in a special environment, and the fact that the environment of carrying out his duties is fraught with dangers on the one hand and necessitates him to move away from his home on the other hand, this places a double obligation on the supplier, i.e. guarantee His safety, as well as his deportation to his homeland. That is why we aim through this research to highlight the importance of this commitment and its necessity for the process of maritime work to the fullest extent, and we also want to clarify the extent to which it reaches and its specificity, following an analytical approach.
