حق المطل في القانون المدني الجزائري

Résumé: يحق للمالك قانونا فتح مطلات على الملكية المجاورة للإطلال منها إلى الخارج، شرط احترامه لقيد المسافة القانونية وهي بالنسبة للمطلات المواجهة لا تقل عن مترين على ملك الجار، بينما في المطلات المنحرفة لا تقل عن ستين سنتيمترا ما لم يكن المطل المنحرف مواجها في الوقت ذاته للطريق العام. أجاز المشرع الجزائري اكتساب ارتفاق المطل غير القانوني بالتقادم إذا لم يعترض الجار عليه طيلة مدة التقادم. Abstract: The owner is legally entitled to open views of the neighboring property in order to look out from the outside, provided that he respects the restriction of the legal distance and is with respect to the facing frontiers no less than two meters on the property of the neighbor, while in the deviant views not less than sixty centimeteres unless the perverted view is facing at the same time the main road. The Algeria legislator permits the acquisition of an illegal provision for statute of limitations if the neighbor does not object to it during the statute of limitations.
