الحق في بيئة عمل آمنة من المخاطر النفسية: نظرة على التشريع الجزائري وبعض التشريعات المقارنة

Résumé: الملخص: كان للتحوّلات الاجتماعية والاقتصادية الأثر البالغ في ظهور طائفة جديدة من المخاطر في الأوساط المهنية، وهي مخاطر غير فيزيولوجية تسمى بالمخاطر النفسية، وتتعلق أساسا بضغوط العمل وظروفه القاسية. واعتبر الكثير من الخبراء والمختصين أن الصحة النفسية في العمل تمثل رهان جديد في سوق العمل بسبب انعدام الأمن الاجتماعي والاقتصادي والوظيفي.كما سار الاهتمام الدولي والوطني إلى ضرورة التدخل لبسط الحماية من عواقب المخاطر النفسية على صحة الأجراء وسير المؤسسة، تفعيلا لمبدأ صيانة صحة العامل الجسدية والمعنوية وحقه في الكرامة الذي تكرسه المواثيق الدولية. The social and economic transformations had a great impact on the emergence of a new range of risks in professional circles, which are non-physiological risks called psychological risks, and are mainly related to work pressures and harsh conditions. Many experts and specialists considered mental health at work as a new bet in the labor market due to social, economic and job insecurity. International and national interest has also moved to the need to intervene to extend protection from the consequences of psychological risks on the health of employees and the functioning of the institution, in order to activate the principle of safeguarding the worker's physical and moral health and his right to dignity enshrined in international conventions.
