Résumé: ان أمر الأداء مفيد في مجال تحصيل الديون المدنية و التجارية و التوسع فيه سيسمح بتخفيض الضغط الناجم عن تراكم القضايا في الجهات القضائية و يتميز بالسرعة و بالبساطة و تماشيا مع أهمية موضوع أمر الأداء بالنسبة للقاضي و المتقاضي فإننا تطرقنا إلى كل النقاط المتعلقة بنظامه من خلال طرح و معالجة الإشكالات المرتبطة بمفهومه و شروطه و الإجراءات المتبعة لإستصداره و كذا الإختصاص و طرق الطعن و سقوطه و تنفيذه حتى الإلمام بالموضوع .
