نظام تسليم المجرمين في الاتفاقيات الدولية والتشريع الوطني

Résumé: الجريمة قديمة في المجتمع قدم الإنسانية ، تصدى لها المشرع الدولي والمشرع الوطني ، ومن بين أساليب مكافحة الجريمة القبض علي مرتكبي الجرائم وتسليمهم للمحاكمة قصد توقيع العقاب عليهم وعدم إفلاتهم من العقاب ، لذلك كان نظام تسليم المجرمين من أنجع الأساليب المتبعة للحد من الجرائم ، وعليه فقد خص نظام تسليم المجرمين بتشريع دولي وتشريع وطني قصد تبيان النظام القانوني لتسليم المجرمين ، من خلال هذا الطرح يمكن أن نطرح الإشكال التالي فيما يتمثل نظام تسليم المجرمين من خلال الاتفاقيات الدولية وكذا التشريع الوطني ؟ نتناول هذا الموضوع في محورين المحور الأول تحت عنوان نظام تسليم المجرمين في الاتفاقيات الدولية اما المحور الثاني تحت عنوان نظام تسليم المجرمين في التشريع الوطني، ونخلص في النهاية إلى ان نظام تسليم المجرمين إجراء خطير ماس بحقوق الإنسان فلا يمكن تطبيقه إلا وفق الشرعية القانونية سواء أكانت على المستوى الدولي او الوطني. Abstract: Crime is as old in society as humanity، it has been dealt with by the international legislator and the national legislator، and among the methods of combating crime is the arrest of the perpetrators of crimes and their delivery to justice to punish them. And to avoid the impunity of criminals the extradition system is one of the most effective methods used to reduce crimes. As a result، several national and international laws have been enacted to regulate the legal system of extradition. The issue raised by this study is: what is the extradition system through international conventions and national legislation? We will approach this subject in two axes، the first axis entitled; the extradition system in international conventions، while the second axis is titled; the extradition system in national legislation. Finally، it can be concluded that the extradition system is a dangerous procedure that violates human rights and that it can only be applied in compliance with legality، whether at the international or national level.
