التنظيم القانوني للصندوق الوطني للتقاعد في الجزائر

Résumé: لقد أولى المشرع الجزائري أهمية كبيرة لموضوع التقاعد، حيث اشتملت نصوص القانون على قواعد منظمة له بغية تحقيق حماية وأمان الموظف الجزائري، وقد ظهر التقاعد في الجزائر في فترة الاستعمار واستمر العمل به بعد الاستقلال، كما ظهرت عدة أنظمة في سنوات السبعينيات فتعددت الأنظمة وكذا الصناديق المكلفة بها، لذلك عمل المشرع على إدخال نظام مختلف عن سابقه في سنة 1983م بموجب القانون رقم 83/12 وكان الهدف وراء هذا الإصلاح هو تأسيس نظام تقاعدي جديد يقوم على توحيد القواعد المتعلقة بتقدير الحقوق وكذا الامتيازات بالإضافة إلى توحيد التمويل، فأصبح الصندوق الوطني للتقاعد الهيئة الوحيدة المكلفة بتسيير التقاعد. الكلمات المفتاحية: النظام القانوني، الصندوق الوطني، التقاعد، التسيير. Abstract: The Algerian Legistlatur atteched great importance to the issue of Retirement, as the provisions of the law lncuded cities in order to achieve the protection and security of the Algerian employee. Retirement Appeared in Algerian during the frensh colonisatian and it lasted even after Independance, many regimes appeared during the 1970s, whiche created a muliplieity of regimes and the funds chavged with it, this pushed the legistlature insert a different system during 1980 to the law 83/12, this reforme was set to establish a unified retirement system whitch in itself unified the rules related to the rights and advantages, thus the national retirement fund became the only institution charged with managing retirement.
