الجزاءات المترتبة عن مخالقات قواعد التأمين في التشريع الجزائري

Résumé: ملخص: إن موضوع هذا البحث يبين الجزاءات المترتبة عن مخالفات قواعد التأمين في التشريع الجزائري المنصوص عليها في قانون العقوبات وقانون المرور، و قوانين التأمين بما فيها الأمر 95/07 المؤرخ في 25/01/1995 المعدل و المتمم بالقانون 06/04 المؤرخ في 20/02/2006 المتعلق بالتأمينات. و من هذه الجرائم ما هو متعلق بالأشخاص الطبيعية كالمؤمن لهم نتيجة ارتكابهم لها كعدم امتثالهم لإلزامية التأمين أو الأشخاص المعنوية كشركات التأمين نظرا لعدم التزامهم بالقواعد المقررة قانونا سواء بالنسبة للإنشاء أو التسيير. الكلمات المفتاحية : جزاءات – قواعد التأمين – عقوبات – مرور . Abstract: The object of this topic relates to the sanctions due to the infringements of the rules of insurance in the Algerian legislation envisaged by the penal code and the laws relating to the insurance such as the ordinance 95/07 of 25/01/1995 relating to the insurance amended and supplemented by Law 06-04 of 20/02/2006. Among these offenses those relating to natural persons such as insured persons who commit them due to non-compliance with the obligation of the insurance provided for by article 190 of ordinance 95/07 of 25/01/1995 or legal persons like insurance companies when they do not comply with the rules relating to the conditions of their creation or management.
