استثمار الأموال الوقفية في الجزائر تحقيقا للمقاصد الشرعية وتطبيقا للنصوص القانونية

Résumé: يعتبر الوقف من أهم مصادر التمويل الشرعية والذي حضي باهتمام كبير من طرف الدول الرائدة في هذا المجال، حيث إن القائمين على هذه الأوقاف والمكلفين بإدارتها قد تجاوزوا حدود ما يمكن تحقيقه للوصول للغرض الذي من أجله أنشئ هذا الوقف، وهو أن يكون له أثر إيجابي من جانب، مع ضمان استمراريته من جانب آخر، لذا يهتم الباحثون بشكل خاص بموضوع استثمارات الوقف وكيفية استغلال عوائدها لتمويل مشاريع جديدة، فاكتشفوا طرقاً مبتكرة لاستغلال أموال الوقف أبرزها "الاستثمار عن طريق الصكوك الوقفية"؛ وكان للجزائر نصيب من هذا الاهتمام بالأملاك الوقفية، إذ تمكنت من سن قوانين تنظم الوقف بشكل عام وكيفية استثماره بشكل خاص، والتي أتاحت للمستثمرين التصرف في أموال الوقف وفق مجموعة من العقود صاغها المشرع، ، سمحت بتمويل مشاريع عدة؛ لذا تأتي هذه الدراسة لتتناول أهم المفاهيم والعقود المرتبطة بالوقف واستثماره، وإبراز كل هذه العناصر في الجزائر من خلال تقديم نماذج ممولة بالأملاك الوقفية. Abstract Waqf is considered one of the most important legitimate sources of financing and has received great attention from the leading countries in this field, as those in charge of these Waqf work to have a positive impact on the one hand, while ensuring its continuity on the other hand. Therefore, researchers are interested in the issue of Waqf investments and how to exploit them. Their returns to finance projects, so they discovered innovative ways to do so, most notably “investment through Waqf instruments.” Algeria had a share of this interest in Waqf properties, as it enacted laws regulating Waqf and how to invest them, which allowed the investment of its money and the financing of several projects through contracts drawn up by the legislator. The study will address the concepts and contracts of Waqf and its investment, and will present models in Algeria financed by Waqf properties.
