تسيير القضاء في الجزائر خلال الفترة العثمانية

Résumé: ملخص هذا الموضوع يعالج مسائل تتعلق بتسيير القضاء في الجزائر إبان الحكم العثماني، ومن خلاله نتعرف على مكانة هذا المرفق الهام في الدولة وكيف استطاعت الدولة العثمانية من فرض هيبتها من خلال مرجعية المذهب الحنفي والمحافظة على مرجعية السكان الأصليين في الجزائر؟، والمتمثلة في المذهب المالكي، وكيف كان سير المؤسسة القضائية في الجزائر خلال هذا العهد رغم اختلاف المذاهب، وتحديد المعالم الأساسية للمؤسسة القضائية في الجزائر خلال تلك الحقبة الزمنية، ومن حلال ذلك معرفة وكشف طرق تسيير القضاء في الجزائر خلال تلك الفترة، والتأكيد على أن القضاء لعب دورا مهما في تاريخ الجزائر خلال العهد العثماني لإبراز فاعلية القضاء في الحياة الاجتماعية والاقتصادية وتبيين المرجعيات التي كان القضاء يعتمد عليها خلال تلك الفترة الزمنية. بيان أنواع الهيئات القضائية وكذا أنواع القضاة ومعرفة الجوانب الاجتماعية والثقافية والاقتصادية للقضاة في عهد الحكم العثماني، وإظهار المميزات التي اتصف بها القضاء الجزائري خلال الفترة العثمانية، بإبراز الطرق والأساليب التي يتبعها القضاة في إصدار الأحكام. الكلمات المفتاحية: القضاء ــــــــــــ الأحكام ــــــــ الفترة العثمانية ــــــــ القضاة Abstract This topic deals with issues related to the management of the judiciary in Algeria during the Ottoman period, and through it we learn about the status of this important facility in the state and how the Ottoman state was able to impose its prestige through the reference of the Hanafi school and preserve the reference of the indigenous people in Algeria?, represented by the Maliki school ,How was the judicial institution in Algeria during this era despite the differences in doctrines, and determining the basic features of the judicial institution in Algeria during that period of time, and through that knowing and revealing the methods of managing the judiciary in Algeria during that period, and emphasizing that the judiciary played an important role in the history of Algeria During the Ottoman era to highlight the effectiveness of the judiciary in social and economic life and to clarify the references that the judiciary relied on during that period of time.
