أثر مفهوم وحدود المعاهدات الدولية على التحفظ
Résumé: تثير المعاهدات الدولية من حيث مفهومها وحدودها عدة إشكالات قانونية تتعلق باعتبارها مصدرا من مصادر القانون، وتتعلق هذه الإشكالات بإتمام المعاهدة أو التحفظ عليها؛ حيث تعبر المعاهدة الدولية بقوة كافية عن إرادة مشتركة لشخصين أو أكثر من أشخاص القانون الدولي، وهذا التعبير عن الإرادة يهدف لإرساء سيادة القانون في النظام القانوني في إطار التعبير عن الإرادة الخاضعة مباشرة للقانون الدولي. مما يحتاج إلى إعادة النظر في مفهوم وحدود المعاهدة وتأثير ذلك على كل ما يتعلق بها. وسنناقش في هذا البحث تأثير مفهوم وحدود المعاهدات الدولية على التحفظ في المعاهدات الدولية. The International treaties, in their concept and their limits, give rise to legal problems as the primary source of international law, regarding the completion or reservation of a treaty. The expression of will is directly subject to international law. This should review the concept of the treaty, its limits and its impact on everything related to it. In this paper, we will discuss the impact of the concept and limits of international treaties on reservations in international treaties.
