دور عقد الاستصناع في تمويل الصناعات الصغيرة والمتوسطة _ دراسة حالة الجزائر _

Résumé: تم التطرق في هذه الدراسة إلى إبراز دور وأهمية عقد البيع بالاستصناع لدى البنوك الإسلامية في حل إشكالية تمويل الصناعات الصغيرة والمتوسطة ومدى فعاليته في تمويل احتياجاتها التمويلية بالحجم اللازم والتكلفة المناسبة. وتحليل واقع وآفاق تطبيق البنوك الاسلامية في الجزائر لصيغة عقد بيع الاستصناع، وكذا تحليل مختلف أوجه وصور التطبيق العملي لها على مستوى كل من بنك البركة الجزائري ومصرف السلام- الجزائر لمعرفة مدى مطابقتها لأحكام الشريعة الإسلامية. فرغم توفر الأرضية القانونية والتنظيمية لعقد الاستصناع يظل تطبيق البنوك الاسلامية لهذه التقنية التمويلية جد محدود نظرا لحداثة تطبيقها في الجزائر من جهة، وعدم إدراك مدى أهميته كبديل تمويلي فعال للصناعات الصغيرة والمتوسطة من جهة أخرى. This study deals the role of the Istisna'a sale contract with Islamic banks in solving the problem of financing small and medium industries and the extent of their effectiveness in financing their needs with the necessary volume and appropriate cost. And analysis of all kinds of practical application of it in both the Baraka Bank of Algeria and the Peace Bank - Algeria to find out the extent of their conformity with the provisions of Islamic Sharia. Despite the availability of legal and regulatory grounds for the Istisna'a contract, the application of this financing type by Islamic banks remains very limited due to the recent application in Algeria on the one side, and the lack of awareness of its importance as an effective financing alternative for small and medium industries on the other.
