Résumé: ملخص: مفهوم الغير في القانون التجاري من المسائل التي استرعت اهتمام الفقه نظرا لخصوصيته عن الغير في القانون المدني، إذ يستمد هذه الخصوصية من أحكام القانون التجاري التي تقوم على السرعة والائتمان، والتي يتعذر معها تطبيق نظريات تعريف الغير في القانون المدني، لذلك لابد أن يستند في تحديده انطلاقا من معايير تعكس الواقع التجاري من خلال المعاملات التجارية أو من خلال الشخص القائم بها، وهذا ما ذهب إليه ضمنيا المشرع في العديد من النصوص التي تناولت الغير في القانون التجاري. Abstract: The concept of the other is one of the issues That Got the attention of the jurisprudence due to the caractéristique That distinct It frome the Other in the civil Law. It gets the spécificité frome the provisions of the commercial Law That are based on speed and crédibilité and with which we canot Apply the théories of the définition of the other in the civil Law. There fore, It must rely on some criteria in determining the other. Thèse criteria reflets the commercial status-quo through commercial transactions or the personne in charge. This Is what the Législature opted for implicitly in Manny textes That discussed the other in the commercial Law.
