التراخيص الإجبارية كآلية لاستغلال براءة الاختراع

Résumé: ملخص تشكل التراخيص الإجبارية لبراءة الاختراع قيدا عن الحقوق الاستئثارية الممنوحة للمخترعين، فاستغلال المخترعين لاختراعاتهم واستفادتهم منها هم ودولتهم ومجتمعهم هو الوضع الملائم لمنح الحماية القانونية للبراءات، فإذا تقاعس هؤلاء عن الاستغلال بصفة مطلقة أو طوال فترة معينة، أو كان استغلالهم محدودا، وبصورة غير كافية لا تلبي الاحتياجات المطلوبة للدولة والمجتمع، فلا مناص من تدخل الدولة بمنح التراخيص الإجبارية لعدم الاستغلال أو النقص فيه أو من أجل المنفعة العامة متى تطلب الأمر ذلك مع مراعاة الشروط القانونية المطلوبة. الكلمات المفتاحية: الاختراع، براءة الاختراع، التراخيص الإجبارية، الحقوق الاستئثارية، المنفعة العامة. Abstract Compulsory patent licenses constitute a restriction on the exclusive rights granted to inventors. The inventors’ exploitation of their inventions and their benefiting from them, their state and society is the appropriate situation for granting legal protection for patents. The required needs of the state and society. It is inevitable for the state to intervene by granting compulsory licenses for non-exploitation, lack of exploitation, or for the public benefit whenever necessary, taking into account the required legal conditions.
