النظام القانوني لعقد التجارة الالكترونية

Résumé: في ظل العولمة والتطورات التكنولوجية التي شهدتها مختلف القطاعات والنشاطات وخاصة النشاط التجاري الذي مر بمراحل عديدة متأثرا بالتكنولوجيا الحديثة مما أدى إلى ولادة تجارة جديدة عرفت بالتجارة الإلكترونية، وهو نمط حديث من المبادلات حيث يتم بيع السلع والخدمات وإبرام العقود وعقد الصفقات وغيرها من المبادلات التجارية التي تبرم عن بعد، بمعنى دون حضور أي طرف من أطراف المبادلة أو العقد وذلك بالاستعانة بتقنية الاتصال الإلكتروني والمتمثلة في شبكة الانترنت، وهي شبكة عالمية يستخدمها أشخاص وشركات من جميع أنحاء العالم دون تمييز بينهم. وبالرغم من أنها تخضع للكثير من الأنظمة القانونية والقضائية كونها تجارة إلكترونية تتم عن بعد أي عن طريق شبكة الانترنت فإن القواعد العامة في القانون المدني عجزت عن معالجة بعض المشكلات التي تطرأ على هذا النوع من التعاقد، وخاصة من الناحية القانونية فيما تعلق بتبادل الإيجاب والقبول عبر الانترنت، فصيغة التعاقد الإلكتروني وخصوصيته لا يخرج عن مفهومه التقليدي في أحكام القانون المدني الجزائري، على الرغم من وجود خصوصية تفرضها طبيعة العقد الإلكتروني باعتباره يبرم عن بعد باستخدام وسائل اتصال حديثة. Summary of the research in English: In light of globalization and technological developments witnessed by various sectors and activities, especially commercial activity, which has gone through many stages affected by modern technology, which led to the birth of a new trade known as electronic commerce, which is a modern pattern of exchanges where goods and services are sold, contracts are concluded, deals are concluded, and other commercial exchanges are concluded Remotely, meaning without the presence of any of the parties to the exchange or contract, using the electronic communication technology represented in the Internet, which is a global network used by people and companies from all over the world without discrimination between them. Although it is subject to many legal and judicial systems as it is an electronic commerce that takes place from a distance, that is through the Internet, the general rules in civil law have failed to address some of the problems that arise in this type of contract, especially from a legal point of view with regard to the exchange of offer and acceptance via the Internet. The formula of electronic contract and its privacy does not depart from its traditional concept in the provisions of the Algerian Civil Code, despite the presence of privacy imposed by the nature of the electronic contract as it is concluded remotely using modern means of communication.
