دور قاضي تطبيق العقوبات في عملية العلاج العقابي لتحقيق أهداف السياسة العقابية الحديثة

Résumé: تسعى الأنظمة العقابية الحديثة لإعطاء المحكوم عليه مركزا قانونيا داخل المؤسسة العقابية بل و أكثر من ذلك ، فقد ذهبت السياسة العقابية الحديثة إلى إعطاء العقوبة هدفا جديدا و هو إعادة إصلاح و تأهيل الجناة ، و نادت بضرورة تدخل جهة قضائية مختصة لتحقيق هذا الهدف و هذا ما تبناه المشرع الجزائري ، بحيث أسس نظام قاضي تطبيق العقوبات و أوكل له مجموعة من السلطات و الصلاحيات من شأنها أن تساهم و بشكل كبير في عملية العلاج العقابي ، حتى يتمكن من تحقيق التأهيل و الإصلاح للمحبوسين و المساهمة في إعادة إدماجهم في المجتمع. The modern punitive systems seek to give the convict a legal position within the penal institution, ,rather the modern punitive policy has gone further so that it gave the punishment a new goal , which is to re-forme and rehabilitate the perpetrators and called for the intervention of a competent judicial authority to achieve this goal,this is what the algerian legislator adopted and it established the enforcement judge of penalties system and entrusted him many authorities and powers that would contribute significantly to the process of punitive treatment,in order for the detainess to be rehabilitated and to contribute to their reintegration into society
