الحماية الوقائية للبيئة عن طريق الرخص العمرانية (رخصة التجزئة و رخصة الهدم)

Résumé: تضمن القانون رقم 90-29 المتعلق بالتهيئة والتعمير مجموعة من الوسائل القانونية التي تهدف لتهيئة المدن وتنظيمها والارتقاء بالمجال العمراني، منها ما هي جماعية تنظيمية ومنها ما هي فردية، فتتمثل هذه الأخيرة في الرخص العمرانية: رخصة البناء، رخصة التجزئة ورخصة الهدم، بحيث تعتبر هذه الرخص قيود وضوابط على الأفراد لحماية المجال البيئي العام من كل التجاوزات والأخطار التعميرية، كما تعتبر من أهم الوسائل الوقائية التي تمارس الإدارة من خلالها سلطات الضبط الإداري وتبسط رقابتها على العمليات العقارية والحركة التعميرية . summary : Law No. 90-29 of the design and reconstruction, includes a number of legal means that aim at creating and organizing the cities and upgrading the urban area, including the organizational and the individual ones; which are summarized in the urban permits: the building permit, the retail license and the demolition permit. These Licenses are as restrictions and controls on individuals to protect the general environmental field from all abuses and dangers of reconstruction, also they are one of the most important preventive means through which the administration exercises the administrative regulations authorities and simplifies its control over real estate transactions and the movement of reconstruction.
