التحديات القانونية للحد من ظاهرة تعدد الجنسيات في القانون الدولي الخاص

Résumé: إن تعدد الجنسيات يتعارض مع المفاهيم المثالية والأخلاق الدولية التي ينشدها القانون الدولي، إذ أن الأصل أن يتمتع الشخص بجنسية واحدة ولا يتمتع بأكثر منها، لان ذلك يتنافى مع المنطق السليم لمفهوم الشعور بالوطنية. وتعدد الجنسية يعني ازدواجها ويطلق عليه أيضا التنازع الايجابي للجنسية، وهو أن يكون للشخص أكثر من جنسية، إذ يكون وطنيا في أكثر من دولة وهذا راجع لاختلاف الدول فيما بينها حول أسباب اكتساب الجنسية، هذا ما أدى إلى ظهور تعدد الجنسية المعاصر للميلاد والتعدد اللاحق له. ويوجد بين تنازع الجنسيات الايجابي وبين تنازع القوانين علاقة وثيقة، لان الأسس التي تبنى عليها طرق اكتساب الجنسية هي أسس مختلفة، فمنها ما تأخذ برابطة الدم، ومنها ما تأخذ برابطة الإقليم، وأخرى تأخذ بهما معا.الأمر الذي أدى إلى ظهور مشاكل عدة تترتب عن ظاهرة تعدد الجنسيات لا بد من إيجاد حلول قانونية لها. The multiplicity of nationalities is contrary to the ideal concepts sought by international law ،since the original that the person has one nationality and does not enjoy more than one because this is contrary to the common sense of the concept of feeling of patriotism. ،The dual nationality means duplication and is also called the positive conflict of nationality which is that the person is more than a nationality، where he is a national in more than one country’ and this is due to the difference of countries among themselves on ways to acquire nationality’ which led to the emergence of multiple nationality of contemporary birth and right for him. There is a strong conflict between nationality and conflict of laws .a close relationship is the basis on which the rules of citizenship are based- there are different grounds for taking the right of blood’ including what is taken against the region and others that are taken together. Which led to the emergence of problems related to the phenomenon of multi-national must find legal solution to them.
