دور الجمارك في مكافحة تقليد تسميات المنشأ

Résumé: الملخص: انتشرت ظاهرة تقليد تسميات المنشأ على السلع؛ مما يفّعل ذلك دور الجمارك في مكافحة تقليد تسميات المنشأ أثناء حركة التبادل التجاري للسلع عبر الحدود. وتهدف هذه الدراسة إلى ابراز دور الجمارك في مكافحة تقليد تسميات المنشأ من خلال بيان آليات التدخل الجمركي لحماية تسميات المنشأ والأسس التي يستند عليها هذا التدخل، ومن النتائج المتوصل إليها أن الجمارك سلطة عمومية ذات اختصاص أصيل لحماية تسميات المنشأ، كما أن تجريم فعل تقليد تسميات المنشأ يعد حجر الأساس في شرعية التدخل الجمركي. Abstract: The phenomenon of counterfeiting appellation of origin compared with goods has spread; this role shall activate of customs in combating of counterfeiting appellation of origin during the cross-border movement of goods. This study aims to highlighting the role that customs play in combating use as a model of the appellation of origin through with state of customs intervention mechanisms to protect the appellation of origin, and the grounds on which such intervention is based. One of the findings reached is that customs is a public authority with an inherent jurisdiction to protect the appellation of origin. In addition to, criminalization of the act of appellation of origin the appellation of origin is also foundation stone in the legitimacy of customs intervention.
