الإيجار كآلية جديدة للبيع -عقد البيع بالإيجار كنموذج - Rent As A New Mechanism For Sale - Lease Of Sales Contract As A Model

Résumé: في إطار تحيين الترسانة التشريعية الجزائرية ومواكبتها للتطورات الإقتصادية والإجتماعية الحاصلة بصفة عامة، ورغبة منه في تمكين شريحة عريضة من المواطنين ذوي الدخل المحدود من إمتلاك سكن لائق كفيل بضمان عيش كريم، أصدر المشرع الجزائري سنة 2001 المرسوم التنفيذي رقم 01/105 المتضمن عقد البيع بالإيجار في إطار الترقية العقارية، الذي جاء بآليات قانونية تعاقدية جديدة غير مألوفة في ضوء النظرية العامة للعقود تقوم علي فكرة الإيجار إبتداء وإنتهاء بالبيع، فالتمّلُك هو العملية القانونية المُتوخاة من العقد، مما يتعين معه إعطاء المفهوم الذي يوضح تعريف هذا العقد ويبين أهم خصائصه ويوضح شروط الإستفادة منه وإجراءات البيع بالإيجار. In 2001, the Algerian legislature issued Executive Decree No. 01/105, which includes the sale of rent contract for promotio real estate, which came with new contractual legal mechanisms that are not familiar in the light of the general theory of contracts based on the idea of renting starting and ending the sale, ownercy is the legal process envisaged of the contract, which has to give the concept that clarifies the definition of this contract and shows its most important characteristics and explains the terms of use of it and the procedures of the sale of rent
