"الفروق الفقهية عند المالكية من خلال كتاب الشرح الصغير وحاشية الصاوي - نماذج مختارة - "

Résumé: البحث الذي بين أيدينا هو دراسةٌ بعنوان: "الفروق الفقهية عند المالكية من خلال كتاب الشرح الصغير وحاشية الصاوي" "جمعاً ودراسة"؛ قمت بجمع المسائل المتشابهة في الصورة المختلفة في الحكم، والتي أشار إليها الشيخان من خلال كتابيهما ثم التفريق بينها ودراستها، وقد اشتمل البحث على مقدمة ومبحثين وخاتمة. احتوى المبحث الأول على دراسة نظرية للفروق الفقهية، تناولت فيه: تعريف علم الفروق الفقهية، وعلاقته بغيره من فروع الفقه الإسلامي، نشأته، أهميته، تطوره، والمصنفات في الفروق الفقهية في المذاهب الأربعة، ومناهج مؤلفي هذه المصنفات في هذا الفن. واشتمل المبحث الثاني على دراسة تطبيقية للفروق الفقهية الواردة في الكتاب، ويتضمن خمسة مطالب باب من أبواب الكتاب (الطهارة، الصلاة، الزكاة، الصوم والحج) وفي كل باب درست ثلاث مسائل، وكل فرق يتضمن مسألتين فقهيتين غالباً. This research studies the differences in Fikh, entitled: the fikh differences according to the Maliki throng Echarh Saghir and Hachiat Sawi “collection and study”.I have collected the common issues in then supeslicial judgement differences that are mentioned by the two Scholars ti differentiating and studying them. This research has included an introduction, two chapter and a conclusion. The first chapter dealat with a theoretical study of the differences in Fikh differences, its relation it other branches of the Islami Fikh, it emergent works on Fikh differences in the four doctrines and the approaches of the authors of these works in field.The second chapter studied practically the Fikh differences in which I included the study of the Fikh differences mentioned in this book that involve five (cleanness, prayer, chrity, fasting and pilgrimage) from which. I chose three issues in each one and each difference includes two issues in fikh mostly.
